Terms of Service — Coldstar

1. Acceptance

By creating an account or using Coldstar you agree to these Terms. If you don't agree, don't use the game. When you accept the Terms we record the version accepted, the date and the IP address, as proof of the agreement.

2. Eligibility

You must be at least 18 years old to use Coldstar. By registering you confirm you are 18 or older.

3. Beta / Development status

Coldstar is under active development (beta). Bugs, downtime, loss of progress and resets (wipes) of accounts, in-game currency and items may occur. Content, balance and prices may change without notice. By playing you accept these risks typical of a beta.

4. Your Account

You are responsible for keeping your credentials safe and for everything done through your account. An account is personal: you may not transfer, sell, share, or run more than one to gain an unfair advantage. You may not sell, transfer, rent, lend, trade or otherwise make your account available to third parties in any way, even for free, nor buy or otherwise acquire another person's account, nor have your account played by someone else, whether paid or not (so-called "boosting"). A breach may lead to the permanent closure of the account, without refund of virtual goods and subscriptions, and may also affect the other accounts involved. Notify us of any unauthorized access.

5. License & Ownership

We grant you a personal, limited, non-exclusive, revocable license to play Coldstar. The game and all its content — code, graphics, sounds, text, names, characters — remain our property and are protected by copyright. You acquire no ownership, only the right to use it under these Terms. "Coldstar", the Coldstar logo and the related game, ship and feature names are trademarks of Coldstar Games; you may not use them, or any confusingly similar sign, without our prior written permission.

6. Prohibited Conduct

You may not: use cheats, bots, automation or exploits, where an exploit means taking advantage of bugs, errors, malfunctions or unintended behavior of the game, or using game mechanics in ways they were not intended for; decompile or reverse-engineer the client (except, and only to the extent, such restriction is prohibited by mandatory law, e.g. Art. 5(3) and Art. 6 of EU Directive 2009/24/EC), copy, republish, redistribute, modify, or create modified or derivative versions of, the client; sell, offer, advertise, distribute or otherwise make available to others any cheats, bots, exploits, mods, tools, or modified, repackaged or unofficial versions of the client, whether for payment or for free; access or use the Service through any altered, repackaged, third-party or otherwise unofficial client — you may connect only through the official, unmodified client; extract or reuse our content/assets, or scrape data, whether with automated tools or by hand; attempt unauthorized access to our servers or other accounts, or interfere with the operation of the Service, overload it, impair its availability or integrity, or circumvent the technical measures we use to protect it; harass, threaten or abuse other players, or share illegal content, in text or voice chat; send spam or unsolicited advertising, post links or website addresses (including any written so as to evade our controls), promote unofficial services, sites or versions of the client, or defraud, deceive or trick other players to obtain items, resources, advantages, money or credentials from them. You may not manipulate rankings, progress or rewards (e.g. losing on purpose to pass points, transferring advantages between your own accounts, creating secondary accounts to inflate stats, bounties or referrals, or colluding). Except through the features we expressly provide, you may not buy, sell, trade, offer or advertise, for real money or any other benefit outside the game, in-game currency, resources, items, kills, victories or gameplay services, including having other players accompany, protect or strengthen you on those terms. Nicknames, clan/squad names and visible text must not be offensive, deceptive, impersonate staff, or infringe others' rights — we may change or remove them without notice.

7. User Content

You are responsible for the content you submit (pilot name, messages, voice). You grant us the right to transmit and display it within the game so it can function (e.g. showing your name to others, transmitting your voice to nearby players), as well as in rankings, on the game's website and in promotional material for the game (e.g. screenshots, videos). We may remove content or restrict features in case of abuse. Any suggestions or feedback you send us about the game may be used freely, without compensation or obligation.

8. Voice Chat

Proximity voice chat transmits your voice in real time to nearby players and is not moderated or filtered in advance. You are solely responsible for what you say. Transmitting illegal, harassing, threatening, discriminatory or infringing content is prohibited. You can disable listening from the settings menu, and report abuse to legal@playcoldstar.com; we may mute, suspend or ban violators. We are not liable for content transmitted by users.

9. Virtual Goods & Purchases

Credits, in-game currency, the Elite subscription and items are licenses to use within the game, not your property, and have no real-world monetary value: they are not convertible to money or refundable, except where required by law. The Elite subscription lasts for the stated period and does not renew automatically. Random-outcome mechanics (lotteries, auctions, draws, wormhole rewards) do not constitute gambling: participation is voluntary and rewards have no real monetary value. Virtual goods are digital content supplied immediately: by purchasing, you expressly request immediate delivery and acknowledge that, once the digital item has been made available to you, you lose the 14-day right of withdrawal for distance contracts (Art. 59 Italian Consumer Code / Art. 16 Dir. 2011/83/EU); statutory remedies for faulty or non-conforming products remain. Payments are processed by Stripe, whose terms apply to your purchases in addition to these Terms. Unjustified chargebacks or fraudulent payments are treated as abuse: we may suspend or close the account and revoke goods obtained through the disputed transaction.

10. Suspension & Termination

We may suspend or close an account that violates these Terms or harms the game or other players, without notice in serious cases. Where these Terms are breached we may take, proportionately to the seriousness and to any repetition, one or more of the following measures: limit or suspend text and voice chat; suspend the account for a period; close it permanently; cancel progress, items, in-game currency and ranking points obtained in breach of these Terms; exclude from rankings and events. These measures may also affect other accounts where the breach involves them. We may also correct or revoke progress, items, in-game currency and ranking points credited due to a technical error, bug or malfunction, even where there is no breach on your part; in that case this is not a sanction but the restoration of the correct state of the game, and you may still contest it in the same way set out below. We may use automated controls to detect automation, exploits and abuse; automated reports are verified before final measures are taken. If you believe a measure was taken in error, you can contest it by opening a support ticket on our Discord server, stating your account name: we will review the case. If an account is closed for a violation of these Terms, the virtual goods and subscriptions associated with it are not refunded, to the extent permitted by law. Inactive accounts (over 12 months) may be closed and their names/resources freed, where possible after an email notice. You may close your account at any time by contacting us.

11. Service "as is" & Availability

Coldstar is provided "as is". We do our best to keep it running but don't guarantee it will always be available, error-free or uninterrupted. We may suspend or limit the service for maintenance (scheduled or urgent), technical failures or force majeure (events beyond our reasonable control, including provider outages), without this being a breach or giving rise to compensation. We may modify, update or discontinue the game; progress and virtual goods may be affected. The client may update automatically; using an outdated version may prevent access to the game.

12. Indemnification

You agree to hold Coldstar Games harmless from third-party claims, damages, costs and legal fees arising from your use of the game in breach of these Terms or in violation of others' rights, including content you send in text or voice chat.

13. Limitation of Liability

To the extent permitted by law, we are not liable for indirect damages or for loss of progress, virtual goods or data arising from the use or unavailability of the game. Nothing in these Terms excludes liability that cannot be excluded by law, including for willful misconduct or gross negligence.

14. Assignment

We may transfer our rights and obligations under these Terms to a third party (e.g. transferring the game to a company), preserving your statutory protections. You may not assign your account or rights under these Terms.

15. Changes

We may update these Terms. Each version has a number and a date. Material changes will be announced with reasonable notice in-game or by email, and at your next login you will be asked to accept the updated Terms before continuing to play. If you do not accept them, you may stop using the Service and close your account.

16. Governing Law & Jurisdiction

These Terms are governed by Italian law. Any dispute arising from these Terms or from the use of Coldstar shall be subject to the jurisdiction of the Italian courts. This does not deprive you, where you act as a consumer, of the mandatory protections of the law of your EU country of residence, including the right to bring proceedings before, and to be sued only in, the courts of that country.

17. Final Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision or to act on a violation does not constitute a waiver of our right to do so later. Provisions which by their nature are intended to survive (including those on intellectual property, indemnification and limitation of liability) remain in effect after the account is closed.
